Types of Consumer Bankruptcy

There are two basic types of consumer bankruptcy—Chapter 7 bankruptcy and Chapter 13 bankruptcy. Depending on your financial situation, you may be eligible for one and not the other. In Chapter 7 bankruptcy, or straight bankruptcy, you can get rid of your unsecured debts such as credit cards, medical bills, etc. In Chapter 13 bankruptcy, or reorganization, you and your attorney create a payment plan to repay your creditors over 3 to 5 years and you get to keep your assets.
